Deputy McDonald

PROSECUTION:
A LOT HAPPENED BEFORE THE JURY WAS ALLOWED BACK IN THE ROOM:
Some mention was made about using a rape kit on Asha, Defense was upset because currently Michael McClish cannot be revealed to be a convicted rapist.
The DA had mentioned the rape kit, but said he realized the mistake and asked about several other similar kits/tests that are done on found bodies, hoping to draw attention away from the Rape aspect, and make it seem less important. The Defense said they are "Not looking for a mistrial at this time." So McClish can't be handcuffed in front of the jury, or mistrial. Rape cannot be alluded to or there is a mistrial. If they did use a rape kit on Asha, seems they did, why would that be unfair to the defense since it was an aspect of the investigation? Why cant McClish be revealed as a convicted felon rapist, as he was proven to be both in his trial and his failures for an appeal? I know it would alter the Jury's opinion of him, but why shouldn't it? But I digress:

We spoke yesterday about the tarps recovered during the investigation, were all the tarps located at the McClish household?
Yes.

Did you also go to the Glen Arbor Property?
Yes.

Yes. [they went over the jars, making a big deal over who labeled what, capitals varying, the dates, who sealed, etc].

You were involved in the surveillance of Michael McClish and his car?
Yes.

When?
3:00PM.

This began at Ben Lomond Market?
Yes.


Where was it parked?
On Highway 9, facing south right in front of the market, across the street from Valley Churches United and the Ben Lomond Fire Department.


McClish left Ben Lomond Market and went where?
He went to the Hihn Road house, at about 4:30 or 5:00PM.


On the 13th he washed his truck?
Yes he sprayed it off, using no soap or rags.


September 14th did you observe him going to work?
No, we picked up surveillance after he started.


Were you present when he left work?
Yes.


Where did he go?
Directly home.


September 14th you watching McClish wash his car again?
Yes, this time with a pressure washer.


Did you ever meet Melisa McClish?
No.


You were told to bring Michael McClish in for questioning?
Yes.


Did you see a tow truck?
No.


Were you present for the towing?
No.

No, it's the Dr's area, very controlled, I don't move from the wall. I am really just there to take notes, I have been present at several autopsies before, watched Dr collect larvae on the 16th, but I wasn't present for the autopsy of the baby on the 18th.
