Kate Hildenbrand, The Woman Who Discovered Asha's Body

Where do you live?
I live near the top of Love Creek, in Ben Lomond.

What is it you do?

How far up Love Creek are you from Ben Lomond?
About 3 miles up from Ben Lomond Market.

Did you have a cell phone in 2006?
Yes, Verizon was my provider.

Did anyone you live with have any other companies providing their cell service?
Yes, my sister and brother in law used AT&T.

Describe the traffic on Love Creek?
Almost none, very slow.


When did you learn about Asha being missing?
In early September of 2006.


On September 14, 2006 did you walk down Love Creek?
I walked my dog down Love Creek towards Ben Lomond as I normally would. I would meet my husband at some point on his commute home, and he would drive myself and our dog back home. I left between 5:00PM and 6:00PM that day, trying to time it with when my husband drives home. 5 minutes down Love Creek from my house I saw some dirt that was disrupted on the side of the road going towards the creek. I looked down towards the creek and saw Asha's body. I turned home and called 911. I then drove back to the end of the road to meet the Sheriff, and took him to the location of the disturbed dirt and Asha's body. I had market the spot on the road with a towel.

Could you see what Asha was wearing from the top of the road when you first found her?
Yes, she was wearing Ben Lomond Market attire: Khaki pants, and a maroon sweatshirt with the BLM logo.

DEFENSE:
Was there a transient problem near your house?
There was previously, but it had been cleared out months before September. The home owner of the house the transients had been staying at had passed away, the property was shuttered and the transients did not return.

I believe they were discussing the problem with one juror overhearing another talking about the case with an unknown woman during the lunch break (later revealed to be his mother). Judge talked to the Juror without the others present, he was a reserve and Judge Burdock was clearly disappointed at his failure to take directions, I believe he was excused.
